These Website Terms & Conditions (“Terms”) govern your access to and use of the B1D website, applications, and services (together, the “Platform”). By accessing or using the Platform, you agree to these Terms.

If you do not agree, you must not use the Platform.

These Terms are intended for a UK audience. Some consumer protections cannot be excluded where they apply.

• Buyer means a user who places a bid or buys an item.
• Seller means a user who lists an item for sale or auction.
• Listing means an item posted for sale or auction on the Platform.
• Auction means a time-limited listing where buyers place bids.
• Buy It Now means a listing that can be purchased immediately at a fixed price.
• Commission means the percentage fee charged by B1D to sellers on completed sales.
• Subscription means the paid plan (if any) that applies to a seller account, including listing limits and commission rates.
• Content means text, images, messages, listings, and other materials provided by users.

You may need an account to use certain features. You must provide accurate information and keep it up to date. You are responsible for all activity on your account and for keeping login details secure.

You must be at least 18 years old and have legal capacity to enter into binding contracts to use the Platform.

B1D may limit multiple accounts and may require verification to protect users and the Platform.

B1D is a technology marketplace platform only. B1D enables sellers and buyers to connect, list items, bid, and purchase.

• B1D does not own, inspect, store, or deliver items listed by users.
• B1D is not a party to the contract formed between buyer and seller.
• All legal responsibility for the item and the transaction rests with the buyer and seller.

Sellers are solely responsible for their listings, including accuracy of descriptions, photographs, authenticity, condition, legality, and compliance with UK law.

Sellers must ensure listings are not misleading, do not infringe intellectual property rights, and do not include prohibited items (see section 6).

Sellers and buyers must not use the Platform to solicit off-platform transactions in a way that avoids fees or undermines Platform integrity.

You must not list, sell, buy, or promote items that are illegal, unsafe, or that B1D reasonably considers likely to cause harm (physical or mental) or otherwise breach these Terms.

Examples (non-exhaustive) include:

• Illegal weapons or restricted weapon items under UK law
• Explosives, fireworks, or hazardous materials
• Items intended to facilitate harm or violence
• Illegal goods or controlled substances
• Stolen goods
• Content or items promoting hatred, violence, or harassment

Antiques and historically accurate items: Some items (including antiques and historically accurate replicas) may be permitted only at B1D’s discretion following review.

B1D may remove any listing at any time where it considers the item or listing may breach these Terms or present risk.

Sellers may be required to hold an active site subscription to list items. Subscription levels may limit the number of active listings and may provide different features.

B1D charges sellers a commission on completed sales. Commission rates depend on the seller’s subscription level and may start from 5% of the final sale value.

B1D may change subscriptions, listing limits, and fees with reasonable notice by updating the Platform and/or these Terms.

Users are responsible for any taxes applicable to their sales or purchases (including VAT where applicable).

By placing a bid, a buyer is making a binding commitment to purchase the item if they win the auction, subject to any seller-stated terms and applicable law.

The winning bidder is the highest valid bidder at the auction end time (subject to any reserve price and Platform rules).

Minimum bid increments are set by B1D and may vary by price band. The current increment structure is available on request and/or published on the Platform. B1D may amend bid increments from time to time.

B1D may cancel bids, suspend listings, or restrict accounts where it reasonably suspects shill bidding, bid manipulation, fraud, or policy breaches.

Sellers may set reserve prices on auction listings. Reserve prices must be reasonable and broadly reflective of market value.

B1D may request information about a reserve price, restrict the use of reserve prices, or remove a listing where a reserve is considered unrealistic, misleading, or harmful to marketplace integrity.

• Buy It Now listings may be automatically relisted where enabled and where permitted by the subscription level.
• Auction listings are not automatically relisted and must be manually relisted by the seller.

B1D may limit relisting where it reasonably suspects abuse or manipulation.

The Platform may provide messaging tools to enable communication between users.

B1D is not responsible for messages received or sent via the Platform and does not verify, endorse, or accept liability for:

• any statements, representations, or promises made by users
• agreements made outside the Platform
• links, attachments, or files shared between users
• abusive, unlawful, or misleading communications

Users communicate at their own risk. B1D may (but is not obliged to) investigate or remove communications that breach these Terms.

Where B1D provides or integrates payment processing, B1D acts as a technology facilitator only. B1D does not guarantee payment clearance, transfer timing, buyer solvency, or seller performance.

Any payment disputes are primarily between buyer and seller unless a confirmed platform fault directly caused the issue.

Delivery, collection, postage, insurance, and logistics are agreed between buyer and seller. B1D is not responsible for:

• lost, delayed, or damaged items
• courier failures
• collection disputes, missed collections, or storage costs

Risk in the goods passes according to the seller’s stated terms and/or applicable law. Buyers and sellers should document handover and condition.

Return and refund policies are set by individual sellers unless otherwise stated. B1D does not guarantee that a return or refund will be accepted.

Disputes about item condition, authenticity, delivery, refunds, or buyer/seller behaviour are primarily between buyer and seller. B1D may provide a reporting or dispute process for platform administration, but:

• B1D is not obliged to investigate or mediate disputes
• B1D is not responsible for enforcing refunds, returns, or compensation
• Any B1D decision is administrative only and does not determine legal liability

Nothing in these Terms limits any rights that cannot be excluded under UK law. Where consumer rights apply, they remain between buyer and seller.

B1D may suspend, restrict, or terminate accounts (and remove listings or content) where it reasonably believes this is necessary to:

• enforce these Terms or policies
• protect users or the Platform
• address suspected fraud, manipulation, or unlawful activity
• respond to legal or regulatory requirements
• address unpaid fees, abusive behaviour, or repeated disputes

Where appropriate, B1D may act without prior notice (for example, where there is an immediate risk to users or the Platform).

The Platform is provided on an “as available” basis. B1D does not guarantee uninterrupted availability and is not liable for:

• downtime, maintenance, or outages
• missed bids due to connectivity or device issues
• message delays
• third-party service failures (including payment providers)

Where a confirmed Platform fault directly causes a transaction error, B1D’s liability is limited as set out in section 17.

To the fullest extent permitted by law, B1D is not liable for indirect or consequential losses, including loss of profit, loss of business, or reputational damage, arising from use of the Platform or from transactions between users.

B1D is not liable for disputes, non-payment, non-delivery, item condition, authenticity issues, returns, or refunds where these are outside B1D’s direct control.

Where B1D is liable to you in connection with a specific transaction, B1D’s total liability is limited to the fees paid to B1D for that transaction (if any), unless a higher limit is required by law.

Nothing in these Terms excludes or limits liability for:

• death or personal injury caused by negligence
• fraud or fraudulent misrepresentation
• any liability that cannot be excluded under UK law

You agree to indemnify and hold B1D harmless from claims, damages, losses, liabilities, and expenses arising from:

• your listings, bids, purchases, or sales
• your communications or content
• your breach of these Terms or applicable law
• your infringement of third-party rights

B1D’s handling of personal data is described in the B1D Privacy Policy.

B1D may update these Terms from time to time by posting an updated version on the Platform. The updated Terms will apply from the effective date shown. Your continued use of the Platform after changes take effect constitutes acceptance.

These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except where mandatory consumer protection rules provide otherwise.
